These Terms & Conditions ("Terms") govern the rental, purchase, and use of mobile cooling trailers and related services provided by Cool Zone Mobile Trailers ("Cool Zone," "we," "us," or "our"), located in Dripping Springs, Texas. By requesting a quote, booking a rental, purchasing equipment, or using our services, you ("Customer," "you") agree to these Terms.
1Services
Cool Zone provides mobile misting-fan cooling trailers for rental or purchase, including delivery, setup, and pickup where arranged. Coverage, cooling performance, and temperature reduction vary with ambient conditions, humidity, wind, placement, and power supply, and are estimates rather than guarantees.
2Quotes & Bookings
- Quotes are estimates based on the information you provide and are valid for 30 days unless stated otherwise.
- A booking is confirmed only when we accept it in writing and any required deposit is received.
- Pricing, availability, and delivery windows are subject to change until a booking is confirmed.
3Payment
- Rental fees, delivery charges, deposits, and applicable taxes are due as stated on your invoice or rental agreement.
- A security deposit may be required and will be refunded after the equipment is returned in good condition, less any charges for damage, loss, or excess cleaning.
- Late payments may incur additional fees.
4Delivery, Setup & Access
- You are responsible for providing safe, legal, and reasonable access to the delivery site, including adequate space, level ground, and any required power source.
- You are responsible for obtaining any permits, permissions, or approvals required for equipment placement at your location.
- Delivery and pickup times are estimates and may be affected by weather, traffic, or conditions outside our control.
5Use of Equipment (Rentals)
- Equipment must be used only for its intended purpose and operated in accordance with any instructions we provide.
- You may not move, modify, sublease, or relocate the equipment without our written consent.
- You are responsible for the equipment from delivery until pickup, including loss, theft, vandalism, or damage beyond normal wear.
- Equipment involving water and electrical power must be kept clear of hazards; do not tamper with electrical connections or misting systems.
6Cancellations & Changes
Cancellation and rescheduling terms, including any non-refundable deposits, will be set out in your booking confirmation or rental agreement. We may cancel or reschedule for safety reasons or events beyond our control and will work with you on a refund or alternative date where possible.
7Safety & Assumption of Risk
Cooling equipment reduces heat but does not eliminate the risk of heat-related illness. You are responsible for monitoring the well-being of people at your site, providing water and rest, and following applicable health and safety guidance. Cool Zone is not a substitute for medical care or professional safety planning.
8Warranties & Disclaimers
Except as required by law, services and equipment are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose. We do not guarantee specific temperature outcomes.
9Limitation of Liability
To the fullest extent permitted by law, Cool Zone is not liable for indirect, incidental, or consequential damages, including lost profits or business interruption. Our total liability arising from any rental, purchase, or service will not exceed the amount you paid for that rental, purchase, or service.
10Indemnification
You agree to indemnify and hold harmless Cool Zone, its owners, and employees from claims, damages, and expenses arising out of your use of the equipment or your breach of these Terms, except to the extent caused by our negligence or willful misconduct.
11Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Texas.
12Changes to These Terms
We may update these Terms from time to time. The version posted on this website at the time of your booking or purchase applies to that transaction.
